Terms of use

These terms govern access to and use of the Smisle Is Life platform operated by LE SOURIRE C'EST LA VIE. They are a technical draft to be validated by counsel before production.

The platform enables creating, publishing and supporting crowdfunding campaigns in euros. Access may be suspended for maintenance or security reasons.

Users must provide accurate information, keep credentials confidential and report unauthorized use promptly. Accounts may be suspended for breaches of these terms.

Every campaign requires administrative review before publication. The administration may request changes, refuse, suspend or remove a campaign for non-compliance, fraud risk or prohibited content.

Donations may be public or anonymous to the public (identity may remain available to the administration). A platform minimum applies. Offline donations may be recorded manually by admins without increasing payout balance.

Online payments are processed via Stripe and/or PayPal when enabled. Donation confirmation relies on provider webhooks/confirmations, not the browser return alone.

Funding is flexible: reaching the goal is not required to request withdrawal of amounts actually available per the ledger.

The initial platform fee is 17% of the gross amount, snapshotted on each contribution. Provider fees (Stripe, PayPal) may apply and are shown when known.

Creators configure a payout account (encrypted IBAN). Requests are processed manually after checks. Available balance excludes non-payout-eligible manual donations.

Campaign owners are responsible for the accuracy of campaign information and use of funds. The platform provides a technical service and is not a party between owners and contributors, subject to applicable law.

Platform content (brand, interface) belongs to LE SOURIRE C'EST LA VIE or partners. User-provided content remains under their responsibility.

The administration may suspend an account or campaign for breaches. Users may request account closure subject to accounting and legal retention duties.
